1. Definitions

• Service: the leaked credential monitoring and related services offered by Secure Pwn.
• User: an individual or entity that registers for, or otherwise uses, the Service.
• Account Data: account identifiers (such as email addresses) provided by or on behalf of the User for monitoring.

2. Scope of Service

Secure Pwn monitors publicly available sources, third-party data breaches, and certain dark web sources for occurrences of User-supplied Account Data. We provide alerts and reports based on matches found. The Service is provided on a best-effort basis and does not guarantee detection of every data leak or breach.

3. Eligibility and Account Requirements

You must be at least 18 years old and have authority to submit Account Data for monitoring. If access is limited to corporate/work email domains (for example, through a permitted-domain policy), you agree to provide only permitted addresses. Misrepresenting ownership or permission to monitor an email/account is strictly prohibited.

4. Trial Access

Where a time-limited trial is offered, trial access is provided for a fixed duration (e.g., 2 days) and on a read-only basis unless otherwise stated. Secure Pwn may suspend or terminate trial access at any time for any reason.

5. User Obligations

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You will only submit Account Data you are authorized to monitor and will not use the Service for unlawful or malicious purposes.
• You agree to comply with applicable laws and these Terms when using the Service.

6. Data Handling & Privacy

Secure Pwn collects and processes the Account Data you supply and other technical information to provide the Service. Our Privacy Policy explains how we collect, use, retain, and share personal data. By using the Service you consent to the processing described in the Privacy Policy.

7. Security

We implement reasonable administrative, technical, and physical measures designed to protect data processed on behalf of Users. However, no internet-connected system is perfectly secure. We cannot guarantee absolute security and are not liable for unauthorized access that is beyond our reasonable control.

8. Intellectual Property

All rights, title, and interest in the Service, including all related software, reports, content, and trademarks, are and will remain the exclusive property of Secure Pwn or its licensors. You are granted a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

9. Fees & Payment

Where paid features are offered, you agree to pay the fees and taxes described at the time of purchase. Fees are non-refundable except as required by applicable law or as expressly stated in writing by Secure Pwn.

10. Acceptable Use

You must not: (a) attempt to probe, scan, or test the vulnerability of the Service; (b) interfere with the normal operation of the Service; (c) use the Service to facilitate illegal activities; or (d) attempt to gain unauthorized access to other accounts. We reserve the right to suspend accounts engaged in prohibited activity.

11. Limitation of Liability

To the maximum extent permitted by law, Secure Pwn and its affiliates will not be liable for indirect, incidental, consequential, special, or exemplary damages arising out of your use of, or inability to use, the Service—even if advised of the possibility of such damages. Our aggregate liability for direct damages will not exceed the total fees paid by you to Secure Pwn in the 12 months preceding the event giving rise to liability (or, if no fees were paid, a nominal amount of ₦10,000).

12. Indemnification

You agree to indemnify and hold Secure Pwn harmless from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of applicable law.

13. Termination

We may suspend or terminate your access for violation of these Terms, non-payment, or for any conduct that threatens Secure Pwn or other users. On termination, your right to access the Service ends and we may delete stored Account Data subject to our Privacy Policy and any legal requirements.

14. Changes to Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the Service or by other reasonable means. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria without regard to conflict-of-law principles. Any dispute arising under or in connection with these Terms will be submitted to the exclusive jurisdiction of the courts located in Lagos, Nigeria, unless otherwise agreed in writing.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
